Kakimichi

1. Purpose
These terms govern the use of the Kakimichi iPad app and of the kakimichi.fr website, both published by Damien Baudet (see the legal notice). By installing or using the app, you accept them.
2. The app
Kakimichi is an app for learning Japanese writing (hiragana, katakana and kanji), designed for iPad and Apple Pencil. It works without an account. An optional account (Apple or Google) serves only to sync progress across several iPads; how it works is described in the privacy policy.
3. Plans
The app offers three plans:
- Free: the complete hiragana and katakana course, with no time limit.
- Kakimichi Pro: a monthly or yearly subscription giving access to all the content (kanji, dictation, quizzes, syncing). The subscription renews automatically and can be cancelled at any time in your App Store settings; cancellation takes effect at the end of the current period.
- Pro in one payment: a one-time purchase giving access to the same features, with no subscription.
Current prices are shown in the app and on the App Store before any purchase.
4. What the one-time purchase covers
The "Pro in one payment" plan is not a subscription: a single purchase unlocks all the Pro features of the Kakimichi app, app updates included.
It covers the Kakimichi app and how it develops, including content and features added to it later. It does not cover any separate product or app sold on its own. The publisher undertakes to keep the app in working order for as long as reasonably possible; should it ever be discontinued, users would be told at least six months in advance and the app would remain usable locally in its last version, within the limits of iPadOS changes beyond the publisher's control.
5. Purchase, payment and refunds
Purchases (subscriptions and the one-time purchase) are made exclusively through the App Store and processed by Apple, acting as the seller. Billing, VAT, the right of withdrawal and refund requests fall under Apple's terms, reachable from reportaproblem.apple.com. The subscription is tied to your App Store account and can be restored on a new device from the app's settings.
6. Syncing
Syncing progress across iPads relies on an online service. The publisher works to keep it available but cannot guarantee uninterrupted operation. The app remains fully usable without an account and without syncing: progress is then saved locally on the device. Should the syncing service ever be shut down for good, users would be told on the same terms as in article 4.
7. Licence to use, and intellectual property
The app, its design and its content are protected by copyright. Buying a plan grants you a personal, non-exclusive, non-transferable licence to use it, limited to private use on your own devices. Third-party data used by the app (strokes, dictionary, fonts) is credited on the Licences page.
8. Legal guarantees
You have the benefit of the statutory guarantee of conformity applicable to digital content and services (articles L224-25-1 and following of the French consumer code), which covers in particular the supply of updates needed to keep the app in conformity.
9. Liability
Kakimichi is a teaching tool. The publisher does not guarantee any particular learning outcome, nor success in an exam or certification (JLPT or otherwise). Using the app is no substitute for teaching suited to your own goals.
10. Deleting your account
You can delete your account and the data attached to it at any time, straight from the app: Settings → Account → Delete account. Deleting the account does not end a running subscription, which is managed in your App Store settings.
11. Changes to these terms
These terms may be changed, in particular to follow how the app or the law develops. The version in force, dated, is published on this page. Should a substantial change affect your rights, you will be told inside the app.
12. Governing law and disputes
These terms are governed by French law. In the event of a dispute, an amicable solution will be sought first: write to contact@kakimichi.fr. Under articles L612-1 and following of the French consumer code, you may also refer the matter free of charge to a consumer ombudsman. The European Commission additionally provides an online dispute resolution platform.
